The Public Foundation Legal Policy Research Centre has prepared expert proposals on the draft Regulatory Resolution of the Supreme Court of the Republic of Kazakhstan “On the Application of Legislation on the Protection of Honor, Dignity and Business Reputation in Judicial Practice”.

The expert analysis is analytical and advisory in nature. The submitted materials examine selected provisions of the draft Regulatory Resolution in terms of their compliance with the current legislation of the Republic of Kazakhstan, international obligations related to freedom of expression, as well as their potential implications for judicial practice.
Particular attention is paid to the following issues:
- distinguishing between the protection of honor, dignity and business reputation and the regulation of digital content;
- maintaining a balance between the protection of personal non-property rights and freedom of expression;
- legal certainty and predictability of judicial practice;
- procedural aspects of evidence and the appointment of expert examinations;
- legal safeguards for mass media and journalists.
The expert proposals aim to contribute to the development of a consistent, balanced and predictable judicial practice in cases concerning the protection of honor, dignity and business reputation.
